Title IX

Title IX of the Education Amendments of 1972 is a federal civil rights law that prohibits discrimination on the basis of sex in the university's programs and activities. Sexual harrassment, including sexual violence, and relaliation are forms of discrimination prohibited by Title IX.

No person in the United States shall, on the basis of sex, be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any education program or activity receiving Federal financial assistance. - Title IX of the Education Amendment of 1972

Sexual Misconduct Policy

WHO IS COVERED BY TITLE IX AT LINDSEY WILSON COLLEGE?

Educational institutions that receive federal financial assistance are covered by Title IX. If only one of the institution's programs or activities receives federal funding, all of the programs within the institution must comply with Title IX regulations. In compliance with Title IX, Lindsey Wilson College prohibits discrimination in employment as well as in all programs and activities on the basis of sex.

LINDSEY WILSON COLLEGE STATEMENT OF NON-DISCRIMINATION

Lindsey Wilson College does not discriminate on the basis of race, color, national origin, sex, disability, or age in its programs and activities as required by Title IX of the Educational Amendments of 1972, the American with Disabilities Act of 1990, Section 504 of the Rehabilitation Act of 1973, Title VII of the Civil Right Acts of 1964, and other applicable statues and College policies. College programs and activities include but are not limited to athletics (NAIA and club sports), admissions, financial aid, and employment.

Lindsey Wilson College will not tolerate any form of sexual misconduct. The College is required by law to investigate complaints of sexual misconduct. The College has a responsibility to investigate and ensure a fair, effective, comprehensive, and timely response to complaints. The College will take prompt and effective action to address allegations of sexual misconduct.

FAILURE TO COMPLY WITH TITLE IX

The penalty for failure to comply with Title IX in the most extreme circumstances can include the termination of all or part of an instu=itution's funding. This inculdes grants, subsidies, and other program funds from the federal government. In addition to the loss of federal funds, universities may be sued by those seeking redress for violations of Title IX. It is essential that institutions receiving federal financial assistances operate in a nondiscriminatory manner. To ensure the College's compliance with the law, adherence to the Title IX regulations is everyone's responsibility

WHO ENFORCES TITLE IX?

The United States Department of Education's Office of Civil Rights (OCR) is in charge of enforcing Title IX. Information regarding OCR can be found at the Office for Civil Rights website.
